A federal court ruling on the drugmaker's marketing of an erectile dysfunction drug on Tuesday that is being compared to prescription drug Viagra was stopped after a court hearing.
Judge William Young said the Food and Drug Administration's (FDA) approval of the drug, Viagra, for sale in the U. S. is based on an analysis of data from an FDA review of more than 1,000 drug sales, and that he found that the drug "is not medically appropriate for a patient with erectile dysfunction or impotence."
The FDA approved the drug for a condition called impotence, or low blood pressure, when a man is unable to get or maintain an erection. The FDA decision comes just a few weeks after a federal appeals court upheld a lower court's ruling that the company's marketing of a drug similar to Viagra is illegal under the Food and Drug Act.
The FDA has not yet determined whether the drug has any possible risk to consumers, the company said.
The FDA also had not decided whether the drugmaker would be required to add a black box warning to the label of its drug, and that was the FDA's first decision. The drug maker would still face a black box if the FDA did not approve Viagra for the treatment of erectile dysfunction.
The case is just the latest in a series of legal proceedings by drugmakers to challenge the FDA's decision to approve Viagra.
